1 Introduction

These general conditions govern and regulate any sale undertaken through the auction house Nomisma Aste S.r.l. with registered premises in Verona (VR), at Via Legnago n. 144, paid-up share capital € 250,000.00, VAT and Tax Code. n. 04871770238, email address [email protected] and certified mail: [email protected] (hereinafter also referred to as ‘Auction House’).

The lots for sale are owned by third parties (hereinafter the ‘Seller’) who have mandated sale to the Auction House by signing up to a contract under which commission is payable on sale (mandate without representation).

2 Information and estimates

Illustrations, descriptions, values and estimates of lots contained in catalogues and in any other illustrative and informative material are purely indicative and to be used only for lot identification.

Illustrations, descriptions, values and estimates do not constitute conventional guarantees or quality promises in any way pursuant to articles. 1490 and 1497 of the [Italian] Civil Code and cannot be relied upon by third parties.

The estimated values published do not include the commissions of the Auction House, the costs of rights below, or customs, export, and VAT expenses.

Further information regarding a specific auction may be entered on the website of the Auction House, in the catalogue or communicated in the auction room before or during the sale.

Where discrepancies appear between the text of the General Conditions published in the Auction catalogue and the text published on the website of the Auction House, the latter will prevail.

In case the client after the auction sends a coin to any Grading Companies, the judgement of the above-mentioned Companies about the conservation and more precisely about, for example, the definitions of CLEANED, DETAILS, etc. cannot be contested to Nomisma Aste S.r.l. and won’t give the client the right to ask the termination of the contract.

3 Examination of lots

The lots offered for sale are to be considered as used goods supplied as antiques and, as such, cannot be classified as “products” under the definition set out in Article 3, letter (e) of the Consumer Code (Legislative Decree No. 206 of September 6, 2005).

Interested parties are allowed to examine lots on sale before auction in the days and during the times established by the Auction House. 

Unless otherwise stated, the movements of the watches are to be considered not serviced.

4 Registration, acceptance of the General Conditions, proxies

In order to participate in an auction, it is necessary to register and fully accept the present General Conditions.

Registration entails tacit, full acceptance of these General Conditions.

Participants in the auction may be asked to provide information and bank references.

In particular situations, the Auction House reserves the right to request that participants in the auction pay deposits to guarantee the balance of the sales price and the auction commissions and may, at its sole discretion, prohibit unwelcome or unsuitable individuals from entering the room or bidding.

Should the participant act in the name of and on behalf of another person or legal entity, they must exhibit written authorization of the power of proxy for the auction. The Auction House reserves the right not to allow representatives of third parties to participate in the auction if, under its own final judgment, it does not consider the power of proxy to be proven.

After registration, a numbered bid card will be provided to the participants in the room to signal bids to the auctioneer during the auction.

All lots sold will be invoiced to the name and address indicated in the registration form. Complaints or disputes will not be accepted for possible mislaid or lost bid cards.

The Auction House is exempted from any responsibility in the event of failure to effectively participate due to any problems that may occur during or previous to the telephone and/or internet connection.

5 Participation via correspondence, telephone connection, or online

Potential buyers will be able to participate in the auction, subject to prior signing of specific forms, by correspondence, by telephone connection, or online. By sending and signing the above-mentioned forms, the participant agrees to take part in the specific auction and undertakes to pay the declared price and auction commissions, should their bid be successful. The participant also undertakes to verify, at the end of the auction, whether their bid was successful, thereby excluding the Auction House from all responsibility in this regard. Incorrectly completed bids made by means of correspondence will not be accepted.

The Auction House declines all responsibility towards those who participate in an auction by telephone and/or online in the event of failure to effectively participate due to any problems that may occur during or previous to the telephone connection and/or online connection.

6 Awarding of lots

The starting price of the auction will be the price indicated as a base, except when a different and higher offer was reached before the auction opened, in which case the starting price will be that of the bid made following this offer. In the event of equal bids made via correspondence, the bid that arrived first will take precedence and, in any case, such bids will have priority over equal bids made in the room. The bids will be regulated at the discretion of the auctioneer. The auctioneer reserves the right to withdraw, add, group or divide the lots, as well as the right to reject a bid made in the room or sent in writing. Lots will be awarded to the highest bidder. The Auction House reserves the right to cancel the award in the event of third-party disputes that claim ownership of the lot. 

7 Auction commissions and tax regime

In the event of a successful bid, the Auction House applies the following commissions (VAT included):

• 21% for floor, absentee (pre-auction), telephone, email bids and written bid from offers form
• 24% for live and autobid bids
• 21% for unsold lots purchased subsequently through the shop

Unless otherwise stated, the lots are sold under the margin scheme pursuant to Article 40-bis of Decree-Law No. 41 of February 23, 1995.

 

Lots marked with an asterisk (*) are instead subject to the standard VAT regime (5%), calculated on both the hammer price and the buyer’s premium.

In the case of a distance sale to a private EU customer with VAT due in the country of destination, the VAT rate of the relevant EU country will be applied.

For lots purchased through other platforms, the following buyer’s premiums apply:

• Onebid: 24%
• Biddr: 24%

8 Lots subject to temporary importation (T.I.)

Lots purchased under the Temporary Importation regime cannot be collected directly by the buyer, but must be shipped, at the end of the Temporary Importation procedures, by the Auction House at the buyer’s expense. The same will be indicated in the auction catalogue.

9 Payment

Payment must be carried out as follows:

• for in-room bidders, prior to the collection of the lots;
• for absentee, telephone, and online bidders, within 15 (fifteen) calendar days from the date of receipt of the pro forma invoice.

Payments made by individuals other than the buyer will not be accepted.

The Auction House will issue an invoice as soon as payment is made for the contracted assets.

In the event that the buyer fails to pay the purchase price or any other amount due, the Auction House shall have the right, at its sole discretion, to:

• return the property to the consignor, requiring the defaulting buyer to pay, as a penalty, the lost commissions;
• take legal action to enforce the obligation to purchase;
• sell the lot by private treaty or in subsequent auctions on behalf of and at the expense of the buyer, pursuant to Article 1515 of the Italian Civil Code, without prejudice in any case to the right to claim damages.

After the above-mentioned term has elapsed, the Auction House shall in any case be released from any liability towards the buyer for any deterioration or damage to the lots and shall be entitled to charge storage fees for each individual lot, in addition to any reimbursement of expenses for transport to the warehouse, in accordance with the tariff available upon request. Any risk of loss or damage to the awarded property shall pass to the buyer from the moment of the hammer fall. The buyer may collect the purchased goods only after full payment to the Auction House of the price and any other applicable commission, cost, or reimbursement.

Late payment interest will be applied on all amounts unpaid within the terms indicated above at an annual rate of 5% (five-per-one hundred).

10 Collection and delivery of lots sold

Until complete payment is made of the amount due, the lots are stored at the Auction House and insured with suitable care and at the expense of the Auction House until 30 (thirty) calendar days from the auction end.

After the integral and prompt payment of the buyer, as indicated in Terms of Sale and without prejudice to the legislation in the field of the protection of Cultural Heritage (see point 12), the Auction House will proceed with the shipment of the awarded lots within 10 (ten) calendar days from the payment receiving, without prejudice to strikes or extraordinary events.

On request the delivery of the lot will be arranged at the Auction House by appointment.

11 Export of lots

Customs and export expenses (duties, taxes, excises and other ancillary expenses) are borne by the buyer.

In order to export any good over 50 years old a certificate of free circulation is necessary, which is released by the Monuments and Fine Arts Office. Requests to issue a certificate of free circulation for export will be carried out by the Auction House on behalf of the buyer.

At least 10-12 weeks are required to obtain export authorization.

Lots imported temporarily cannot be collected by the buyers, but must be shipped, at the expense of the latter, by the Auction House.

N.B. All the lots marked with the § symbol cannot be exported. Nomisma Aste will not apply for export permits for said lots, as we consider the release of the permits highly unlikely. For this reason, such lots will be shipped/delivered exclusively within Italian territory, even in the case of foreign buyers. The inability of a foreign customer to collect and store the lots in Italy does not constitute grounds for cancelling the auction purchase. 

The export permit release is subject to specific procedures at Monuments and Fine Arts Office via SUE web page:

• Lots value under 50,000 euros: Autocertification (DVAL), estimated waiting time 50/60 days from the receivement of the application by the Export office
• Lots value over 50,000 euros: Free circulation permit (ALC), estimated waiting time 10/12 weeks from the receivement of the application by the Export office.

The auction house can submit said requests in the buyer's name only after receiving the payment and after the final invoice issue (this one transfers the property of good from the seller to the buyer). Under no circumstance is Nomisma Aste Srl liable for the outcome or the waiting for the mentioned permits.

WATCHES

Please note that straps and any accessories made from materials derived from endangered or otherwise protected species (such as alligator, crocodile, lizard, etc.), in the absence of CITES permits, will not be sold with the watches and are shown in the images for display purposes only. We reserve the right to remove such straps prior to shipment to countries where applicable regulations do not permit their import. Such lots will be marked in the catalogue with the symbol §.

12 Exclusion of guarantee by the Auction House

The lots are sold by the Auction House on behalf of the Seller in the state in which they are at the time of auction with any eventual flaw, defect, imperfection, damage and/or lack of quality.

Each auction is preceded by a public display, allowing any potential buyers to examine the lots and verify their authenticity, state of conservation, origin, characteristics, qualities and any flaws and defects.

In any case, the possible liability of the Auction House towards the buyer is limited to the corresponding award and/or sales price and the purchasing commission paid by the buyer, ancillary expenses such us shipping are not excluded. 

13 Expert assessments and reports

Only in cases provided for by art. 64 of Legislative Decree of 22 January 2004 n. 42, will the Auction House, at the request of the buyer, provide the buyer with a declaration containing any available information on the authenticity of the lot, or, alternatively, on the probable attribution and origin of the same.

14 Terms and evaluations of the Auction House

Every written or verbal communication provided by the Auction House, including those contained in the catalogue, in relationships, comments or evaluations concerning the nature of a lot, such as authorship, authenticity, provenance, attribution, origin, date, age, period, cultural origin or source, its quality, including price or value, exclusively reflect assessments made in good faith by the Auction House and may be reviewed and modified at any time. The buyer, therefore, cannot draw solidly reliable conclusions based on these views, having the right to verify the goods before the auction.

15 Verification of cultural interest

The Auction House, at its sole discretion, may proceed to a temporary adjudication of lots which, before or during the auction, should be the subject of formal initiation of the procedure for the declaration of cultural interest referred to in Article 14 et seq. of Legislative Decree 22 January 2004 n. 42 (Codice dei Beni Culturali - ‘Code of Cultural Heritage’). In the case of temporary adjudication, the Auction House will report the sale to the relevant Ministry pursuant to art. 59 Codice dei Beni Culturali. The sale will be conditionally suspended subject to the issuing of a declaration regarding the nature of the “cultural asset” and to the failure by the Ministry to exercise its pre-emptive rights within the terms of the law. Pending this procedure, the lot cannot be delivered to the buyer.

In the event that the State exercises its right of pre-emption, the successful bidder shall be entitled to a refund of the amounts paid. The refund will be issued by the Auction House only after it has actually received the corresponding payment from the State.

16 Right of resale

Lots that are “Subject to the right of resale” will be subject to the resale rights costs referred to in Legislative Decree 118/2006 and the same will be paid by the buyer.

17 Absence of the right to withdrawal

Bids and online sales undertaken by correspondence and by telephone by the Auction House constitute a remote contract regulated by Chapter I, Title III (Articles 45 et seq.) of the Codice del Consumo (“Consumer Code”) and by Legislative Decree 9 April 2003, n. 70, containing the regulations governing e-commerce.

Art. 59, paragraph 1, letter m) of the “Consumer Code” excludes the right of withdrawal for contracts concluded on the occasion of a public auction, which is the sort of auction organized by the Auction House.

As a result, the right of withdrawal is excluded in relation to lots awarded via remote contract during a public auction.

18 Sale with reservation of ownership

The lots are awarded or sold by the Auction House with reservation of ownership pursuant to Article 1523 of the Civil Code and therefore the ownership of the same will be transferred to the buyer only on complete payment of the due sale price. The risk of decay or damage to the lots will be transferred to the buyer at the time of delivery of the said lots.

19 Legal guarantee for consumers

In the case in which the Seller who mandated the Auction House with the task of selling the lot is a “professional” pursuant to the provisions of art. 18, paragraph 1, letter b) of the Consumer Code (Legislative Decree September 6, 2005 n. 206), the legal guarantee set out by articles 128-135 of the Consumer Code will apply.

20 Applicable law

The present General Conditions and each sales contract with the Auction House are regulated to all effects by Italian law.

21 Jurisdiction

Each and any dispute with the Auction House, including those relating to the interpretation, execution, resolution or validity of this contract will be subject exclusively to competent jurisdiction of the Court of Verona.

Le presenti condizioni generali disciplinano e regolano qualsiasi vendita effettuata per il tramite della casa d’aste Nomisma Aste S.r.l. con sede legale in Verona (VR), via Legnago n. 144, Capitale Sociale Euro 250.000,00 i.v., P. IVA e C.F. n. 04871770238, indirizzo mail [email protected]  e P.E.C. [email protected] (di seguito denominata anche “Casa d’Aste”).

I lotti oggetto di vendita sono di proprietà di soggetti terzi (di seguito il “Venditore”) che hanno conferito mandato alla vendita mediante sottoscrizione di contratto di commissione alla Casa d’Aste (mandato senza rappresentanza).

2 Informazioni e stime

Illustrazioni, descrizioni, valori e stime dei lotti contenuti nei cataloghi ed in qualsiasi altro materiale illustrativo e informativo sono di carattere puramente indicativo e da utilizzare soltanto all’identificazione del lotto.

Illustrazioni, descrizioni, valori e stime non costituiscono in alcun modo garanzie convenzionali o qualità promesse ai sensi degli artt. 1490 e 1497 cod. civ. e non possono costituire affidamento per i terzi.

I valori di stima pubblicati non comprendono le commissioni della Casa d’Aste, i costi dei diritti di seguito, le spese doganali, di esportazione e l’IVA.

Ulteriori informazioni riguardanti una specifica asta potranno essere inserite sul sito internet della Casa d’Aste, in catalogo o comunicate in sala prima o durante la vendita.

Ove si registrassero discrepanze tra il testo delle condizioni generali pubblicato sul catalogo d’asta e quello pubblicato sul sito web della Casa d’Aste, avrà prevalenza quest’ultimo.

In caso in cui il cliente dopo l’asta sottoponga una moneta alle società di grading, il giudizio di queste ultime riguardo alla conservazione ed in particolar per quanto riguarda, ad esempio, le definizioni di CLEANED, DETAILS, ecc. non potrà essere oggetto di contestazione a Nomisma Aste S.r.l. non dando il diritto di risoluzione del contratto.

3 Esame dei lotti

I lotti posti in vendita sono da considerarsi come beni usati forniti come pezzi d'antiquariato e come tali non qualificabili come "prodotto" come da definizione dell’art. 3 lett. e) del Codice del consumo (D.Lgs. 6.09.2005 n. 206).

Agli interessati è consentito esaminare i lotti in vendita prima dell’asta nei giorni e durante gli orari stabiliti dalla Casa d’Aste o previo appuntamento concordato tra le parti.

Salvo diversa indicazione, i movimenti degli orologi sono da considerarsi non revisionati.

4 Registrazione, accettazione delle condizioni generali, deleghe

Al fine di partecipare all’asta è necessario procedere alla registrazione e accettare integralmente le presenti condizioni generali.

Con la registrazione sono integralmente accettate le presenti condizioni generali.

Ai partecipanti all’asta potranno essere richieste informazioni e referenze bancarie.

In particolari situazioni la Casa d’Aste si riserva il diritto di richiedere ai partecipanti all’asta di versare dei depositi a garanzia del saldo del prezzo di vendita e delle commissioni d’asta. Ha altresì il potere discrezionale di negare l'accesso alla sala o di non accettare offerte da parte di acquirenti ignoti o non graditi.

Qualora il partecipante agisca in nome e per conto di un’altra persona fisica o giuridica dovrà essere esibita idonea procura prima dello svolgimento dell’asta. La Casa d’Aste si riserva la facoltà di non far partecipare all’asta rappresentanti di terzi qualora, a proprio insindacabile giudizio, non ritenga dimostrato il potere di rappresentanza.

Ai partecipanti in sala, previa registrazione, sarà fornito un cartellino numerato per indicare le offerte al banditore durante l’asta.

Tutti i lotti venduti saranno fatturati al nome ed all’indirizzo indicati nel modulo di registrazione. Non saranno accettati reclami o contestazioni per l’eventuale perdita o smarrimento del cartellino.

La Casa d’Aste è esonerata da qualsiasi responsabilità nel caso di mancata esecuzione della partecipazione dovuta a eventuali disguidi che possono occorrere durante o precedentemente il collegamento telefonico e/o internet.

5 Partecipazione per corrispondenza, tramite collegamento telefonico, online.

I potenziali acquirenti potranno partecipare all’asta, previa sottoscrizione di appositi moduli, anche per corrispondenza, tramite collegamento telefonico, online. Con l’invio e la sottoscrizione dei moduli di cui sopra, il partecipante accetta di prendere parte all’asta di riferimento e si impegna a corrispondere il prezzo di aggiudicazione e le commissioni d’asta qualora la sua offerta abbia successo. Il partecipante si impegna inoltre a controllare, al termine dell’asta, se la sua offerta è andata a buon fine sollevando la Casa d’Aste da ogni responsabilità in tal senso. Le offerte per corrispondenza compilate in modo errato non saranno accettate.

In seguito a mancato o ritardato pagamento da parte di un acquirente, la Casa d’aste potrà rifiutare qualsiasi offerta fatta dallo stesso o da suo rappresentante nel corso di successive aste.

La Casa d’Aste declina ogni responsabilità nei confronti di chi partecipa all’asta mediante collegamento telefonico e/o online nel caso di mancata esecuzione della partecipazione dovuta a eventuali disguidi che possono occorrere durante o precedentemente il collegamento telefonico e/o on line.

6 Aggiudicazione dei lotti

Il prezzo di partenza dell'asta sarà quello indicato come base, salvo quando non sia pervenuta prima dell’apertura dell’asta un’offerta diversa e più alta, nel qual caso il prezzo di partenza sarà quello dello scatto successivo a tale offerta. In caso di uguali offerte per corrispondenza avrà la precedenza quella giunta per prima e in ogni caso esse hanno priorità su offerte uguali in sala. Gli scatti delle offerte saranno regolati a discrezione del banditore. Il banditore si riserva il diritto di ritirare, aggiungere, raggruppare o dividere i lotti, nonché il diritto di rifiutare un’offerta in sala o inviata per iscritto. I lotti verranno aggiudicati al miglior offerente. La Casa d’Aste si riserva il diritto di annullare l’aggiudicazione in caso di eventuali contestazioni di terzi che rivendichino la proprietà del lotto.

7 Commissioni d’asta e regime fiscale

In caso di aggiudicazione, la Casa d’Aste applica le seguenti commissioni (IVA inclusa):

• 21% per le offerte in sala, pre-asta, telefoniche, tramite mail o modulo per le offerte scritte
• 24% per le offerte live e autobid
• 21% per i lotti invenduti acquistati successivamente nello shop

 

Salvo diversa indicazione, i lotti sono venduti in regime del margine ai sensi dell’art. 40-bis del D.L. 23.2.1995 n. 41.

I lotti contrassegnati con asterisco (*) sono invece soggetti a regime IVA ordinario (5%), calcolato sul sul prezzo di aggiudicazione e sui diritti d’asta.
In caso di vendita a "distanza" a soggetto privato UE con rilevanza IVA nel paese di destinazione sarà applicata l'aliquota IVA del paese UE di riferimento.

Per le aggiudicazioni effettuate tramite altre piattaforme, le commissioni d’asta applicate sono le seguenti:

• Drouot: 24%
• Invaluable: 29%
• Onebid: 24%
• Biddr: 24%

8 Lotti in regime di Temporanea Importazione (T.I.)

I lotti acquistati in regime di Temporanea Importazione non potranno essere ritirati direttamente dagli acquirenti, ma dovranno essere spediti, alla chiusura della pratica di Temporanea Importazione, a cura della Casa d’Aste e a spese dell’acquirente. Gli stessi verranno indicati nel catalogo d’asta.

9 Pagamento

Il pagamento dei lotti aggiudicati deve essere effettuato:

• per i partecipanti in sala, prima del ritiro dei lotti;
• per i partecipanti tramite corrispondenza, collegamento telefonico e online, entro 15 (quindici) giorni di calendario dalla data di ricezione della fattura pro forma.

Il pagamento può avvenire:

Non saranno accettati pagamenti provenienti da soggetti diversi dell’acquirente.

La Casa d’Aste emetterà fattura contestualmente al pagamento dei beni aggiudicati.

Per il caso di mancato saldo del prezzo di vendita da parte dell’acquirente o di ogni altra somma dovuta, la Casa d’Aste avrà diritto, a propria discrezione, di: 

• restituire il bene al mandante, esigendo a titolo di penale da parte del mancato acquirente il pagamento delle commissioni perdute;
• agire in via giudiziale per ottenere l'esecuzione coattiva dell'obbligo d'acquisto;
• vendere il lotto tramite trattativa privata o in aste successive per conto ed a spese dell'aggiudicatario, ai sensi dell'art. 1515 cod. civ., salvo in ogni caso il diritto al risarcimento dei danni.

Decorso il termine di cui sopra, la Casa d’Aste sarà comunque esonerata da ogni responsabilità nei confronti dell'aggiudicatario in relazione all'eventuale deterioramento o deperimento degli lotti ed avrà diritto di farsi pagare per ogni singolo lotto i diritti di custodia oltre a eventuali rimborsi di spese per trasporto al magazzino, come da tariffario a disposizione dei richiedenti. Qualunque rischio per perdita o danni al bene aggiudicato si trasferirà all'acquirente dal momento dell'aggiudicazione. L'acquirente potrà ottenere la consegna dei beni acquistati solamente previa corresponsione alla Casa d’Aste del prezzo e di ogni altra commissione, costo o rimborso inerente.

Verranno conteggiati interessi di mora su tutti gli importi non pagati nel termine sopra indicato ad un tasso annuo pari al 5% (cinque-per-cento).

10 Ritiro e consegna dei lotti venduti

Sino al completo pagamento del prezzo dovuto, i lotti sono conservati presso la sede di Casa d’Aste e assicurati con idonea copertura a cura e spese della Casa d’Aste sino al trentesimo giorno dopo la conclusione dell’asta.

A seguito dell’integrale e tempestivo pagamento di tutto quanto dovuto alla Casa d’Aste dall’acquirente, come previsto dalle condizioni di vendita e fatta salva la normativa in tema di tutela dei Beni Culturali (si veda il punto 12), la Casa d’Aste provvederà alla spedizione dei lotti aggiudicati entro 10 giorni lavorativi dalla ricezione del pagamento salvo scioperi o eventi straordinari.

Su richiesta la consegna del lotto potrà avvenire presso la sede della Casa d’Aste previo appuntamento.  

11 Esportazione dei lotti

Le spese doganali (dazi, tasse, accise e ogni altra spesa accessoria) e di esportazione sono a carico dell’acquirente.

Per esportare qualsiasi bene di interesse culturale avente 50 e più anni è necessario il rilascio da parte del Ministero dei Beni Culturali dell’attestato di libera circolazione. Le richieste di tale attestato saranno effettuate dalla Casa d’Aste in nome e per conto dell’acquirente.

Per ottenere l’autorizzazione all’esportazione sono necessarie, a titolo indicativo, almeno 10/12 settimane.

I lotti importati temporaneamente non potranno essere ritirati dagli acquirenti, ma dovranno essere spediti, a spese di questi ultimi, a cura della Casa d’Aste.

N.B. Per i lotti contrassegnati in catalogo con il simbolo § Nomisma Aste non effettua pratiche di esportazione, ritenendo improbabile il rilascio delle relative autorizzazioni. Per questo motivo tali lotti verranno spediti/consegnati solo ed esclusivamente sul territorio italiano anche in caso di aggiudicatari stranieri. L'impossibilità da parte di un cliente straniero di ritirare e conservare i lotti nel territorio italiano non è motivo di annullamento dell'acquisto in asta.

Il rilascio del permesso di esportazione è subordinato all’inoltro al Ministero dei Beni Culturali di specifiche pratiche tramite il portale web SUE:

• Per lotti di valore inferiore ai 50.000 Euro: Autocertificazione (DVAL) con tempi di attesa di circa 50/60 gg (indicativi) dall'inoltro della pratica al competente Ufficio Esportazione.
• Per lotti di valore pari o superiore ai 50.000 Euro: Attestato di Libera Circolazione (ALC) con tempi di attesa (indicativi) di 10/12 settimane dalla consegna della pratica al competente Ufficio Esportazione.

La casa d'aste procederà ad inviare le richieste di esportazione a nome e per conto dell'acquirente solo ed esclusivamente dopo il ricevimento del pagamento e l’emissione della fattura definitiva (quest’ultima ai sensi di legge trasferisce la proprietà del bene dal conferente all’acquirente), non essendo in ogni caso responsabile dell'esito e/o delle tempistiche di tali pratiche.

OROLOGI

Si prega di notare che i cinturini e eventuali oggetti a corredo realizzati con materiali derivati da specie in via di estinzione o altrimenti protette (ad esempio alligatore, coccodrillo, lucertola…) in mancanza di permessi CITES non saranno venduti con gli orologi ma sono presenti in foto solo a scopo espositivo. Ci riserviamo il diritto di rimuovere questi cinturini prima della spedizione in Paesi in cui le normative in atto non lo consentano. Tali lotti saranno contrassegnati in catalogo con il simbolo §.

 

12 Esclusione di garanzia da parte della Casa d’Aste

I lotti sono venduti dalla Casa d’Aste per conto del conferente nello stato in cui si trovano al momento dell’asta con ogni eventuale vizio, difetto, imperfezione, danneggiamento e/o mancanza di qualità.

Ogni asta è preceduta da pubblica esposizione che permette ai possibili acquirenti di esaminare i lotti e accertarne l’autenticità, lo stato di conservazione, la provenienza, le caratteristiche, le qualità e gli eventuali vizi e difetti.

In ogni caso l’eventuale responsabilità della Casa d’Aste nei confronti dell’acquirente è limitata al corrispondente prezzo di aggiudicazione e/o di vendita e alla commissione d’acquisto pagati dall’acquirente, sono escluse le spese accessorie quali spese di spedizione.

13 Perizie e attestati

Nei soli casi previsti dall’art. 64 del D. Lgs. 22 gennaio 2004 n. 42 la Casa d’Aste, su richiesta dell’acquirente, consegna all’acquirente una dichiarazione contenente le informazioni disponibili sulla autenticità del lotto, o, in alternativa, sulla probabile attribuzione e sulla provenienza dello stesso.

14 Termini e valutazioni della casa d’Aste

Ogni rappresentazione scritta o verbale fornita dalla Casa d’Aste, incluse quelle contenute nel catalogo, in relazioni, commenti o valutazioni concernenti qualsiasi carattere di un lotto, quale paternità, autenticità, provenienza, attribuzione, origine, data, età, periodo, origine culturale ovvero fonte, la sua qualità, ivi compreso il prezzo o il valore, riflettono esclusivamente valutazioni in buona fede della Casa d’Aste e possono essere riviste e modificate in qualsiasi momento. L’acquirente, quindi non può fare alcun affidamento su tali rappresentazioni, avendo facoltà di verificare i beni prima dell’asta.

15 Verifica dell'interesse culturale

La Casa d'Aste, a sua esclusiva discrezione, potrà procedere all'aggiudicazione provvisoria dei lotti che, prima o durante l'asta, siano oggetto di formale avvio del procedimento per la dichiarazione di interesse culturale ai sensi dell'Articolo 14 e seguenti del Decreto Legislativo 22 gennaio 2004 n. 42 (Codice dei Beni Culturali). In caso di aggiudicazione provvisoria, la Casa d'Aste segnalerà la vendita al Ministero competente ai sensi dell'art. 59 del Codice dei Beni Culturali. La vendita sarà sospesa in via condizionale, subordinatamente all'emissione di una dichiarazione sulla natura di “bene culturale” e alla mancata esercitazione del diritto di prelazione da parte del Ministero nei termini di legge. In attesa di tale procedura, il lotto non potrà essere consegnato all'acquirente.

In caso di esercizio del diritto di prelazione da parte dello Stato, l’aggiudicatario avrà diritto al rimborso delle somme corrisposte.
Il rimborso verrà effettuato dalla Casa d’Aste esclusivamente a seguito dell’effettivo incasso del relativo pagamento da parte dello Stato.

16 Diritto di seguito

I lotti in cui viene evidenziato “Soggetti al diritto di seguito” saranno assoggettati al diritto di seguito di cui al D.Lgs. 118/2006 e lo stesso sarà a carico dell’aggiudicatario.

17 Assenza del diritto di recesso

L’offerta e la vendita online, per corrispondenza, per telefono da parte della Casa d’Aste costituiscono un contratto a distanza disciplinato dal Capo I, Titolo III (artt. 45 e ss.) del Codice del Consumo e dal Decreto Legislativo 9 aprile 2003, n. 70, contenente la disciplina del commercio elettronico.

L’art. 59, comma 1, lett. m) del Codice del Consumo esclude il diritto di recesso per i contratti conclusi in occasione di un’asta pubblica, quale è l’asta organizzata dalla Casa d’Aste.

Di conseguenza, è escluso il diritto di recesso in relazione ai lotti aggiudicati tramite contratto a distanza a mezzo asta pubblica.

18 Vendita con riserva di proprietà

I lotti sono aggiudicati ovvero venduti dalla Casa d’Aste con riserva della proprietà ai sensi dell’articolo 1523 cod. civ. e pertanto la proprietà degli stessi si trasferirà in capo all’acquirente solo al momento dell’integrale pagamento del prezzo dovuto per la compravendita. Il rischio di perimento o di danneggiamento dei lotti si trasferirà all’acquirente al momento della consegna dei lotti stessi.

19 Garanzia legale per i consumatori

Nell’ipotesi in cui il Conferente che abbia conferito alla Casa d’Aste l’incarico di vendere il lotto sia un “professionista” ai sensi di quanto previsto dall’art. 18, comma 1, lett. b) del Codice del Consumo (D. Lgs. 6 settembre 2005 n. 206), ai lotti aggiudicati o venduti per il tramite della Casa d’Aste si applicherà la garanzia legale di conformità prevista dagli artt. 128-135 del Codice del Consumo.

20 Legge applicabile

Le presenti Condizioni Generali ed ogni contratto di vendita con la Casa d’Aste sono regolati a tutti gli effetti dalla legge italiana.

21 Foro competente

Per ogni e qualsiasi controversia con la Casa d’Aste, ivi incluse quelle relative alla interpretazione, esecuzione, risoluzione o validità del presente contratto, sarà competente in via esclusiva il Foro di Verona.
