Terms and Conditions – TUMO Gallery auctions on OneBid

1. Organiser
The auction is organised by UAB TUMO GALERIJA (TUMO Gallery), registered office Turgelių g. 1, LT-02103 Vilnius, Lithuania. Gallery: Užupio g. 28, Vilnius. Contact: [email protected], +370 699 64555. The auction is held on the OneBid platform, whose terms of service also apply to the use of the platform.

2. Lots
2.1 Lots are offered as described in the catalogue. Descriptions, attributions and estimates are prepared carefully and in good faith and express the gallery's opinion. Dimensions are given in centimetres, height × width.
2.2 Lots are sold in the condition they are in at the time of the auction. Bidders are encouraged to view the works at the gallery by appointment, or to request a condition report and additional photographs before bidding.
2.3 Each work is accompanied by a certificate of authenticity issued by TUMO Gallery.
2.4 Estimates do not include the buyer's premium or shipping costs.

3. Bidding
3.1 Bidding requires registration on OneBid and acceptance by the gallery. The gallery may refuse a registration without giving reasons.
3.2 Before the auction, bidders can place advance bids (offers) and absentee maximum bids (limits) online. During the live auction the lots are offered one by one in automatic mode, and bids rise according to the increment table shown on the platform.
3.3 The highest bid accepted when the lot closes (the hammer price) wins. Every bid is binding. The purchase contract between the buyer and UAB TUMO GALERIJA is concluded when the lot is knocked down.
3.4 The gallery may withdraw a lot before or during the auction, refuse a bid, or re-offer a lot in the event of a dispute.
3.5 The gallery is not responsible for bids that are not received because of internet connection or other technical problems.

4. Price and payment
4.1 The buyer pays the hammer price plus a buyer's premium of 20% of the hammer price, plus shipping costs if shipping is requested.
4.2 Where the artist's resale right (droit de suite) applies, this is stated in the lot description and the resale royalty is charged to the buyer in accordance with applicable law.
4.3 Payment is due within 7 days of the invoice date, in euros, by bank transfer to the account stated on the invoice.
4.4 If payment is not received on time, the gallery may cancel the sale and claim compensation for its losses, or offer the lot to the underbidder.

5. Ownership and risk
Ownership passes to the buyer upon full payment. Risk passes to the buyer on collection or on handover to the carrier.

6. Collection and shipping
6.1 Lots can be collected free of charge at TUMO Gallery, Užupio g. 28, Vilnius, by appointment, after full payment.
6.2 Shipping is arranged by the gallery with an insured courier. Fixed rates for the EU and for the rest of the world are stated in each lot description and added to the invoice. For large works, as stated in the lot description, insured delivery is quoted individually on request.
6.3 Lots are dispatched within 10 working days of payment. For deliveries outside the EU, import duties, taxes and customs fees are paid by the buyer. Some works may require an export licence; the gallery will apply for it, and the time needed to obtain it does not entitle the buyer to cancel the purchase.
6.4 Please inspect the parcel on delivery and report any transport damage to the gallery within 3 days, with photographs.

7. Complaints and consumer rights
Complaints can be sent to [email protected] and will be answered within 14 days. Nothing in these terms limits the statutory rights of consumers.

8. Personal data
Personal data of bidders and buyers are processed by UAB TUMO GALERIJA only for the purposes of the auction, invoicing and delivery, in accordance with the GDPR.

9. Governing law
These terms are governed by the law of the Republic of Lithuania. Disputes are settled by the competent courts of Lithuania, without prejudice to mandatory consumer protection rules.
